The e-discovery process itself can be a headache with traps for the unwary. War stories abound where poor e-discovery practices have cost litigants, and in some cases, their representatives, dearly.
This is perhaps not suprising given the large volumes of documents and range of technical issues which can arise. The process is complicated by trying to keep a lid on costs whilst demonstrating compliance with discovery rules and preservation of evidence integrity.
So that their lawyers can focus on legal analysis, larger law firms invest in a manager, and sometimes whole teams of staff, to provide this expertise.
